Terms and Conditions of Sale


I. APPLICATION
These general conditions of sale (hereinafter: ‘GCS’) apply to sales transactions concluded by the Hôtel Cloitre Saint-Louis located at 20 rue du Portail BOQUIER, 84000 AVIGNON secondary establishment of the company AP HOTELS SASU. whose registered office is located at 202 Rue de Rivoli 75001 Paris, registered with the RCS 382 499 937 and whose intra-community VAT number is FR 08382499937 (Hereinafter: ‘the Company’) with the Client. These General Terms and Conditions of Sale apply to all use of the site, in particular to the marketing by internet and by telephone of all the services offered on the Site by the Company Cloitre Saint-Louis.
It is therefore imperative that the Customer carefully reads the General Terms and Conditions of Sale, which are referenced by hypertext link on each page of the site. In particular, he/she is advised to download and/or print them in order to keep a copy on the day of his/her order since they are likely to be modified, it being specified, however, that such modifications will be inapplicable to orders for Services made previously.
The GTCs may be supplemented by specific conditions of sale appearing on the description of the Service as well as by the conditions of sale of the service providers, accessible either on their Website or on site.


II. CAPACITY
The Customer acknowledges that he/she has the capacity to enter into a contract, i.e. that he/she is of legal age and is not under guardianship or tutelage.
The Customer also declares that he/she uses the Site in accordance with these GTC, in his/her own name and in the name and on behalf of all the beneficiaries of the services ordered by him/her on the Site for whom he/she acknowledges that he/she is the agent (hereinafter: the ‘Beneficiaries’) and to whom these GTC will be enforceable. The Company reserves the right at any time not to enter into a contract with a Client who makes fraudulent use of the Site or who contravenes these GTC.
In this respect, the terms of article 313-1 of the French Penal Code are recalled:
"Fraud is the act, either through the use of a false name or a false capacity, or through the abuse of a true capacity, or through the use of fraudulent manoeuvres, of deceiving a natural or legal person and thus determining them, to their detriment or to the detriment of a third party, to hand over funds, securities or any property whatsoever, to provide a service or to consent to an act creating an obligation or discharge. Swindling is punishable by five years' imprisonment and a fine of €375,000"
 

III. RIGHT OF WITHDRAWAL
Pursuant to the provisions of article L 121-21-8 of the French Consumer Code, the services offered on the Site by the Company are not subject to the application of the right of withdrawal provided for in articles L. 121-21 et seq. of the French Consumer Code with regard to distance selling.
Consequently, the services ordered on the Site are exclusively subject to the cancellation and modification conditions provided for in these GTC and the Customer may not invoke the right of withdrawal.


IV. PRICES
Prices are quoted in Euros. VAT is included in the prices quoted. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically passed on to the prices indicated on the invoice date.
Rates are per room for the number of people indicated and according to the period selected.
The prices indicated only include the services strictly mentioned in the booking. Any additional services provided by the hotel during the stay will be added to the price mentioned in the booking.
As tourist tax is not included in the rates, it will be payable in addition. The amount of the tourist tax may be modified at any time in accordance with current legislation.
The prices mentioned on the Site may be modified at any time by the Hotel without prior information or notice. Only the price indicated in the booking confirmation by the Company is contractual.
No stay booked before the implementation of any promotional offer will be refunded, even partially.


V. ONLINE ORDERING

The Customer must obligatorily, when placing his/her order:

Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase or any other terms and conditions.
All the data supplied and the recorded confirmation will be deemed proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out.
The Company will send the Client, by any means (e-mail, ordinary mail, fax, etc.), confirmation of the order recorded.
The reservation is firm and definitive only after receipt of the confirmation sent to the Client by the Company. This must include:

  • ‘Booking confirmation’
  • note.
  • Confirmation number
  • Last name, First name
  • Arrival date/Departure date
  • Number of rooms
  • Number of people occupying the room,
  • Additional services if booked (Parking, Breakfasts, Package, etc...)
  • Description of the rate booked and applicable conditions,
  • Price of services booked.

The rates, terms and conditions of a booking are intended for the sale of hotel rooms in accordance with their primary purpose (accommodation). The hotel reserves the right to modify the rates, terms and conditions, or simply to cancel the reservation, if the rooms are used for other purposes such as photo shoots, film shoots, showroom, or interview...


VI. ONLINE PAYMENT TERMS
Depending on the type of reservation made, the price is payable in full when the order is placed (pre-payment) or at the end of the Customer's stay at the Hotel.
In all cases and in order to guarantee their reservation, the Customer is asked to provide their bank card number, with transmission taking place by secure means. Please note that the credit card used to make the reservation must be presented on arrival by the cardholder. Failing this, a new credit card will be requested for payment on arrival.
In the event of a third party taking charge of the stay, the Hotel will require documents for the security of the transaction.
Please also note that the Hotel reserves the right to pre-authorise your credit card at any time prior to your arrival.


VII. MODIFICATION AND/OR CANCELLATION OF A RESERVATION
Cancellations and/or modifications of reservations may be authorised depending on the rate opted for by the Client.
In the case of an option for a cancellable / modifiable rate, any request to modify and/or cancel a reservation must be made as soon as possible and no later than the following deadlines:

  • All year round (except for certain special events): at least 48 hours before the start of the stay.
  • During periods of special events (e.g. 2024 Olympic Games), this period is extended to 72h.

The modification and/or cancellation of a booking is firm and definitive only after receipt of confirmation by email from the Company.
The date of receipt of the request for modification and/or cancellation (by email, post, telephone) is the date used for the cancellation.
In the event of an option for a non-cancellable, non-refundable rate, no changes or cancellations will be accepted and the total amount of the stay will remain the property of the Hotel without the Customer being entitled to claim any reimbursement whatsoever.
In the event of the Customer not showing up at the Hotel and in the absence of a cancellation:

  • The total amount of the reservation will be retained by the Hotel in the case of a ‘Non-cancellable non-refundable rate’ reservation;
  • The first night will be deducted by the Hotel in the event of a ‘Cancellable / Modifiable’ reservation.

In addition, for a stay of at least 2 nights, if the Client does not show up on the first day of the stay, the Hotel is not obliged to keep the room for the remainder of the stay.
The Client is asked to plan to arrive at the Hotel before 6:00 pm and to notify the hotelier in the event of a late arrival, failing which the Client will be considered as not having shown up on the first day of the stay.

The hotel reserves the right to cancel a reservation on D-7 if sanitary conditions do not allow it to welcome the public in satisfactory conditions, guaranteeing safety for its guests and employees. Furthermore, for the same health safety reasons, some of the hotel's services may not be available.


VIII. ACCOMMODATION
In the event that the Hotel is unavailable or in the event of force majeure, the latter reserves the right to arrange for the Customer to be wholly or partially accommodated in a hotel of equivalent or higher category, offering services of the same nature. The transfer will then be at the expense of the hotelier, who may not be sought to pay any additional compensation.


IX. ADDITIONAL SERVICES - PACKAGES
Orders for additional services and/or packages may only be placed at the same time as the reservation for a stay at the establishment on a given, predetermined date.
They may only be used by the Customer during his/her stay at the Hotel. They may only be modified and/or cancelled in accordance with the conditions set out in Article VII hereof.
Small, harmless pets are welcome. A supplement will be charged per day and per animal. Prior authorisation may be required to host an animal.


X. FORCE MAJEURE
The hotel will be exonerated from all liability, without compensation, in the event of partial or total non-performance of a contract resulting from a fortuitous event, the act of a third party or an act of force majeure** The events of force majeure referred to here are all accidental or catastrophic disasters, attacks, fire, total or partial strike, damage and other disasters, a pandemic declared by the World Health Organisation or any measure emanating from the Administrative Authority or the Public Authorities making it impossible to perform the contract or preventing its normal performance.


XI. CLAIMS
Any claim should be addressed to the following postal address: Cloître Saint Louis, 20 rue du Portail BOQUIER, 84000 AVIGNON - France, within 15 days of the departure of the holiday that is the subject of the said complaint. After this period, no claim can be taken into account.


XII. DATA PROCESSING AND LIBERTY
Pursuant to the French Data Protection Act 78-17, Customers are informed that their reservation is subject to computerised personal data processing. Customers have the right to access and rectify the data entered, which may be exercised by contacting the head office: Cloître Saint Louis, 20 rue du Portail BOQUIER, 84000 AVIGNON - France. It is specified that this information will not be communicated to third parties.
The Company offers wifi internet access. The Customer undertakes to ensure that the computer resources made available to him/her will not be used in any way for the purposes of reproducing, representing, making available or communicating to the public works or objects protected by copyright or by related rights, such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required.
The Hotel has a video surveillance system within the common areas of the building as well as the car park.


XIII. LIABILITIES
The Company declines all liability in the event of theft, loss or damage to guests' belongings during their stay.
The Client will be held liable for any damage, deterioration or act of vandalism that may occur as a result of the occupation of the premises and/or as a result of the participants and/or staff for whom he/she is responsible, both to movable, decorative and immovable property belonging or not belonging to the hotel. As a result, the Company has the right to ask the Client to leave the establishment without any compensation and without any reimbursement of the stay in progress, and to reimburse any damage caused by these acts.
Example: Our hotel and our rooms are entirely non-smoking, and failure to comply with this rule will result in a flat-rate deodorisation charge of €250 to restore the room to its original state. In addition, the cost of blocking the room from the day of your departure until the room is put back on sale, in accordance with the hotel's quality standards, will be charged on the basis of the best rate of the day.
In the online sales process, the Company is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown in service, or other involuntary problems.


XIV. Applicable Law
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and formal rules. Disputes will fall under the exclusive jurisdiction of the French courts.
